AN OPEN LETTER TO WASHOE COUNTY COMMISSIONERS
LARKIN, WEBER, HUMKE, GALLOWAY, AND JUNG
This letter is displayed on www.ClickHeer.ComApril 2, 2008
Greetings:
Only a few months ago, you decided to no longer discuss and adopt a meeting's agenda during that meeting. This decision was an action which should have been discussed and voted upon in public during a meeting. Instead, you made said decision in secret, in clear and arrogant violation of the Nevada Open Meeting Law.
You have often been reminded of the following material which is clearly displayed in the OML Manual:
... the legislature finds and declares that all public bodies exist to aid in the conduct of the people's business. It is the intent of the law that their actions be taken openly and their deliberations be conducted openly. NRS 241.010
The OML Manual also states:
The action of any public body taken in violation of any provision of this chapter (the OML) is void. NRS 241.036
Your action taken in secret to no longer discuss and adopt any meeting agenda during that meeting is void. Said action was not taken openly and thereby violated NRS 241.010.
It follows that all decisions made during each and every meeting when you willfully failed to discuss and adopt that meeting's agenda in public is void.
Note that a related OML complaint submitted by Lt. Col. Sam Dehne to the state's corrupt attorney general, Catherine Cortez Masto, included a question about your secret decision to no longer discuss and adopt each meeting's agenda in public. Masto employed deceit by omission in failing to answer said question.
It would be in the best interests of the people of Washoe if you would all resign post haste.
Sincerely,
Guy Felton
Acting Ombudsman for the sovereign people of Nevada
Reno, NV 89509
